APP MLA sent to jail for 2 years on AILLS staff assault case.
Somnath Bharti an APP MLA was sentenced today for two years of jail by the court on assaulting a security staff of AIIMS in a case that was registered in 2016. The APP leader was also imposed with a fine amount of rupees one lakh by the Additional Chief of the Metropolitan Magistrate Ravindra Kumar Pandey. Mr Bharti was however granted bail to enable him to file an appeal before the high court against his jail term and his conviction in the case.
On September 9, 2016 Somnath Bharti along with 300 others brought down the fence at AIIMS, Delhi with a JCB operator according to the prosecutor. The magistrate said “The court is of the considered view that the prosecution had duly proved its case beyond all the reasonable doubts against accused Somnath Bharti.”
Under various sections of the Indian Penal Code (IPC) the court convicted Somnath Bharti. The IPC sections include section 323 (voluntarily causing hurt), section 353 (assault or use of criminal force to deter a public servant from discharge of his duty) and section 147 (rioting). The APP MLA was also held guilty under section 3 of the Prevention of Damage to Public Property Act. All the above mentioned offences carry a maximum punishment of five years in jail. The court cited lack of evidence against the associates and co-accuses of Bharti and acquitted them.
